technically sound.
It is illegal and unethical for an unlicensed contractor to create and stamp engineering
drawings for a construction project—especially when public health and safety are involved.
Likewise, it would not be legal or ethical for any Professional Engineer (PE) to seal a project
that they did not personally design or directly supervise. This practice, known as “plan
stamping”, is prohibited in all 50 U.S. states, including Florida.
The Purpose of an Engineering Seal
The engineering seal is far more than a stamp on paper—it is a mark of professional
responsibility. When a PE applies their seal, they are declaring that the documents are final
and ready for their intended use, were prepared under their direct supervision and control,
and fully comply with all applicable codes, standards, and regulations.
What “Responsible Charge” Means
Florida law defines responsible charge as having direct and continuous control over the
engineering work. This means being involved in the project from its concept and design
requirements, supervising and reviewing the design as it progresses, and providing
consultation and technical oversight. Because Astral is committed to these standards, we
cannot and will not seal drawings that were prepared by others outside our supervision.
Consequences of Illegal Plan Stamping
Plan stamping carries serious consequences for both contractors and engineers, including
suspension or loss of professional license, civil or criminal penalties, legal liability for design
errors, and project delays or rejection at the permitting stage. Astral ensures that every sealed
plan is produced with integrity, accountability, and compliance.
What Contractors Can Legally Create
Contractors and subcontractors can legally prepare certain types of drawings that do not
involve engineering design:
- Shop Drawings: Fabrication and installation details based on engineer specifications.
- As-Built Drawings: Markups showing modifications or changes during construction.
- Drafting Services: Visual technical drawings that must be reviewed and sealed by a PE before use.
When a Licensed Professional Engineer Is Required
A licensed professional engineer must sign and seal drawings for most projects, especially
those submitted for permitting, affecting public safety systems, or involving complex designs
beyond prescriptive codes.
